These Terms of Service ("Terms") govern your use of this website and any project engagement with Eric Kramar Studio LLC, a Pennsylvania limited liability company ("the Studio", "we", "us"). By using this website or engaging the Studio for services, you agree to these Terms.

Website use

This website is provided for informational purposes. Content, pricing, and project examples are illustrative and subject to change without notice. You agree not to misuse this website, including by attempting unauthorized access, disrupting its operation, or scraping its content without permission.

Project engagements

• Project scope, timeline, and final pricing are agreed upon separately, in writing, for each client before work begins. These Terms alone do not constitute a project agreement.
• Starting prices shown on this site (e.g. under "Pricing") are estimates for typical projects, not final quotes.
• Payment terms, revision rounds, and deliverables will be outlined in an individual project agreement or invoice.
• Timelines are estimated in good faith and may shift based on client feedback turnaround, scope changes, or third-party dependencies.
• The client is responsible for providing content, credentials, and feedback in a timely manner; delays on the client's part may affect the project timeline.

Intellectual property

Unless otherwise agreed in writing, ownership of final, fully-paid deliverables (such as a completed website's design and code, excluding third-party or licensed components) transfers to the client upon full payment. The Studio retains the right to reuse general methods, know-how, and non-confidential techniques developed during a project, and to showcase completed work in its portfolio and marketing unless the client requests otherwise in writing.

Third-party services and links

This website and delivered projects may rely on or link to third-party services (such as hosting providers, payment processors, or form-delivery services). We are not responsible for the content, policies, or availability of third-party services outside our control.

Disclaimer of warranties

This website and the information on it are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that this website will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, the Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of this website or from services provided, whether based on warranty, contract, tort, or any other legal theory. Where liability cannot be fully excluded under applicable law, the Studio's total liability for any claim relating to a project will not exceed the amount actually paid by the client for that project.

Indemnification

You agree to indemnify and hold the Studio harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of this website or violation of these Terms.

Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or a project engagement will first be addressed through good-faith direct negotiation between the parties before pursuing formal legal action; any resulting legal proceeding will be brought in the state or federal courts located in Pennsylvania.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

Changes to these terms

We may update these Terms from time to time. Continued use of this website after changes are posted constitutes acceptance of the updated Terms. Individual, signed project agreements take precedence over these general Terms for the scope of that project.
